Delivery, Returns, Exchanges and Refunds.

These terms apply to products ordered via our website and to which a transaction between Stylishmamas and you has been registered as Complete under our website guidelines.

1. Seller.

1.1 The Seller is Stylishmamas, a member of DHM, registered office: Ormerod Rutter chartered Accountants. The Oakley/Kidderminster Rd, Droitwich. WR9 9AY.

 

2. Order process.

2.1 Our display of products on our website is an invitation and not an offer to sell those products to you.

2.2 An offer is made when you place the order for your products. However, we will not have made a contract with you unless and until we accept your offer (see point 2.5 below).

2.3 We take payment from your card, when we process your order and have checked your card details. Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the products.

2.4 If you enter a correct e-mail address we will send you an order acknowledgement e-mail. However, this is not an order confirmation or an order acceptance from us.

2.5 Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the products you have ordered are dispatched to be delivered to the address you have given us. It does not take place until that stage, even though we may have debited your card (see 2.3 above) or we have sent acknowledging e-mails (see

2.4 above). Very occasionally an error may occur resulting in the products described on our website not being the products actually available for sale. If this occurs your order will not be or have been accepted. We may ask you whether you wish to purchase other products we may have available or the products which may have been dispatched to you in error. If so your order will be amended. Otherwise, we will treat any order as cancelled and any incorrect products dispatched will be requested back for full refund.

2.6 The contract will be formed at the place of dispatch of the products.

2.7 All orders that you place on this website will be subject to acceptance in accordance with clause 2.5 of these terms and conditions.

2.8 We do not file details of your order for you to access please print out these terms and conditions and the order acknowledgement for your own record.

 

3. Delivery charges and payment.

3.1 Our delivery charges range between £3.50 and £7.50 depending on the items and value spent. Exceptions will apply and these will be treated separately and accordingly.

For example, Paypal customers will be able to claim back their postage fee after receiving the order and as long as its within the paypal terms and conditions to do so. Please check these before proceeding with your claim. Please note that these can be withdrawn at any time and without notice under Stylishmamas' discretion. See our exceptions below:    

   3.1.1 Where FREE DELIVERY is stated.

   3.1.2 Where a promotion regarding delivery charges apply.

3.2 Payment may be made by the methods indicated on our website.

3.3 You will be charged the current price for buying products from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT (where applicable). We reserve the right to amend prices if there is a change in the rate of VAT. All total prices for goods and services at the checkout represent the total price payable by the customer for those items, regardless of the address for delivery. Other components of the total price at the checkout, including delivery charge, may vary for each customer.

3.4 A delivery charge will be applied at checkout, please view our delivery charges.

3.5 We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the products at the correct price. If we are unable to contact you, we will treat the order as cancelled. We will not accept an order if there is a pricing error.

 

4. Delivery.

4.1 Once an order has been placed and you have received confirmation of the transaction, we will aim to deliver your items within our standard delivery period of 3 - 7 working days. We deliver to any UK address including most British Forces Post Offices. We do not deliver to PO Boxes, orders placed for these addresses will be cancelled and a full refund will be given if you have already paid for the products. We also deliver to the Republic of Ireland.

4.2 Orders may generally require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advise that a delivery has been attempted and that the product(s) have [either been left with a neighbour or] returned to the dispatch centre.

4.3 Once an order has been placed, you shall be notified how many business working days your delivery is going to take. Please note that business working day means all days from Monday to Friday, excluding bank holidays.

4.4 It is your responsibility to ensure the delivery address is ready and able to accept delivery of the product, in particular that there is space for any delivery vehicle to make the delivery.

4.5 For any orders delivered to freight forwarding companies, Hotels, B&Bs, storage and relocation companies nominated by you as accepting delivery on your behalf, we shall have no liability to you in respect of any product which is damaged following acceptance of the delivery by these locations on your behalf. These goods are at your risk on and after delivery to these locations and/or carriers.

4.6 We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather or transport problems.

 

5. Cancellation.

If, for any reason, you wish to do so you have the right to cancel any order you have placed (other than in respect of products made to your specification, clearly personalised). You may cancel an order at any point from placing the order up to fourteen (14) calendar days, from the day after delivery of the product(s) to you. This is in line with the Consumer Contracts Regulations 2013.

The following procedures will apply:

5.1 You can contact us either by e-mail or telephone. If you have contacted us to cancel before delivery of your products, though your order will have been cancelled, normally delivery cannot be interrupted (except possibly if cancellation takes place within 30 minutes of order). Please refuse any delivery of cancelled products or return them to us and in the meantime you must take reasonable care of them.

5.2 For instructions on how to return an order, please visit our Returns & Refunds section. You will not be charged for collection or Royal Mail returns in accordance with our returns process.

 

6. Clearance section.

6.1 The reductions shown are reductions from the original price charged on the website. Occasionally these prices may have applied more than six months ago.

 

7. General.

7.1 Certain products are subject to age restrictions as indicated on the product page. By placing your order for any of these products, you confirm that you have reached the required age. Your entire order will be cancelled if we are unable able to verify your age using the details you have submitted.

7.2 All measurements are approximate.

7.3 The reproduction of colours is as accurate as the photographic and production process will reasonably allow.

7.4 All risk in the products we supply to you, in particular the risk of any loss or damage, shall pass to you on delivery of the products to the address you specify in your order. Ownership of the products shall not pass to you until we have received payment in full in respect of such products.

7.5 We shall not be liable for any indirect losses you may suffer, including any loss of profit, income or anticipated savings as a result of your failure to comply with these terms or your negligence. Save that our liability in respect of any death or personal injury caused by our negligence shall not in any way be restricted.

7.6 These terms, constitute the entire terms on which we will provide products to you and cancel and supersedes all prior arrangements and representations, whether verbal or written.

7.7 We may amend these terms from time to time at our discretion without notice to you. Any amends will be posted on this website and will supersede any terms and conditions previously published by us.

7.8 No delay or failure by ourselves in exercising or enforcing any of our rights or remedies under these terms shall operate as a waiver of those rights.

7.9 If any one or more of the provisions of these terms should be held by any court to be unenforceable, such provision shall be validly restated to as nearly as possible approximate the intent of the clause and, if such clause cannot be restated for any reason, shall be severable from these terms and deleted.

7.10 You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

7.11 All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be in English and construed and governed according to English law and the English courts shall have exclusive jurisdiction in all such matters.

8. Our returns, exchange and refunds policies.

8.1 Subject to exceptions, Stylishmamas is happy to exchange or refund your purchase within 14 working days of delivery. After this period, refunds will not be issued but exchanges may be considered under Stylishmamas' discretion given that the item is returned in stated terms and conditions below.

8. 2 Unwanted goods must be returned in a fully resale-able condition and any tags must be intact. Extra care must be taken when trying on clothing, please ensure you are not wearing any make up, fragrance or deodorant that may leave a scent or mark. We reserve the right to refuse an exchange or refund if goods are not returned in a saleable condition or are damaged.

8. 3 In cases where the above conditions have not been met due to the customer's negligence or miscommunication, it will be up to Stylishmamas' discretion to offer a refund, exchange or store vouchers.

8. 4 You can return items to us via Standard Royal Mail or via Standard courier (this will be covered by us but if you decide to use a more expensive delivery method, you will be responsible for the extra costs, please ensure you retain the receipt for proof of postage which we will ask you to send us a copy via email for our records and quick processing of your refund/exchange ) and after we have received and inspected the product and are happy with its condition ( please see above to what won’t be acceptable ) your refund will be processed and it can take your card provider 3 to 5 working days to credit your account.

8. 5 Should there be any issues during the return process and Stylishmamas are aware of this, you will be given an extention in your return period and your 14 working days will begin again from the last day of correspondence with Stylishmamas.

8. 6 Should you go over this period, it will be up to Stylishmamas' discretion to offer an exchange or store voucher as your full or partial refund period under our terms and conditions (see above) and the Consumer Contracts Regulations 2013 will have passed.

8. 6. 1 Stylishmamas store vouchers may be offered under certain circumstances but this will be done under Stylishmamas' discretion as we have no obligation to do so should you miss the stated deadline above.

8. 6. 2 Please note: It is the consumer's responsibility to read our terms and conditions regarding our policies and Stylishmamas will not take responsibility for not doing so or for not being aware of them. Due care is taken to ensure that the consumer is treated fairly but this does not exclude the consumer from taking necessary actions or responsibilities to enable a pleasant outcome for both parties.

8. 7 In cases where products being returned are lost in the mail, Stylishmamas will not be held liable for this and any issues as such should be dealt with by the delivering courier.

8. 9 In order to avoid unnecessary delays in processing your refund, ensure you use the correct address and follow the instructions carefully.

 

9.  Products excluded from our refund policy:

 9. 1 We are unable to offer an exchange or refund on custom made and altered items unless they are not as described or are faulty.

 9. 2 We are unable to refund or offer an exchange to products that will be deemed unhygienic once the protective layer/material has been tampered with.

 9. 3 This also applies to protective materials covering areas that will help maintain its full use without compromise.

 9. 4 We are also unable to offer an exchange or refund on orders delivered to freight forwarding companies, Hotels, B&Bs, storage and relocation companies, where the product was damaged following acceptance by these locations on your behalf.

 

10. For reasons of health and hygiene we are unable to exchange or refund the following products:

 10. 1 nipple protectors/ shields and breast shells once the original packaging has been opened, unless faulty.

 10. 2 Breast/nursing pads, no exchange or refund unless the adhesive covers are still in place and packaging remains unopened and undamaged unless faulty.

 

THIS POLICY DOES NOT AFFECT YOUR STATUTORY RIGHTS RELATING TO FAULTY OR ITEMS THAT ARE NOT AS DESCRIBED OR YOUR RIGHT TO CANCEL ORDERS UNDER THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS, FURTHER DETAILS OF WHICH ARE AVAILABLE FROM THE LOCAL TRADING STANDARD DEPARTMENT OR CITIZENS ADVICE BUREAU.
